1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Dhangai Police Station Case No. 21 of 2024, dated 28.02.2024, disclosing offences punishable under Sections 8/15/18(C)/25 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. The prosecution case, as per the First Information Report, is that on 8.14 acres of protected forest land, opium plants were sown, which were destroyed by the Forest Officer. The name of the petitioner and other accused persons were disclosed by the local villagers.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.83638 of 2024(2) dt.17-12-2024 2/2 this case on the basis of the disclosure of his name by the villagers, with whom the petitioner has inimical terms. He further submit that the petitioner was not seen at the place of occurrence by the Forest Officer.

5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the criminal antecedent of the petitioner, I am not inclined to grant the petitioner privilege of anticipatory bail.
