2. Application is filed seeking modification of the order dated 06.08.2025, passed in Cr. Misc. No. 31919 of 2025, whereby while extending the privilege of regular bail, a direction was given to verify the criminal antecedent of the petitioner and in case, at any stage, it is found that the petitioner has concealed his criminal antecedent, the Court below shall take immediate step for cancelling the bail bond of the petitioner.

3. Learned Advocate for the petitioner seeking apology and submitted that on account of non disclosure of complete criminal antecedent in the bail petition by the wife of the petitioner, who was not knowing about the real position of the criminal history inconvenience has caused to the Court. The

No.81740 of 2025(2) dt.12-12-2025 2/2 petitioner has disclosed with respect to only one criminal antecedent, though he bears two more other criminal antecedent, as has been disclosed in the modification application. The petitioner seeks apology for non disclosure of the criminal antecedent, as the same was not intentional and a sheer mistake on account of non communication. It is further submitted that, be that as it may, now the petitioner is still in incarceration, despite the bail having been granted by this Court on 06.08.2025, as he has not been released till date.

4. Having considered the submissions advanced by learned Advocate for the petitioner and the averments made in the modification application, the order dated 06.08.2025 passed in Cr. Misc. No. 31919 of 2025 stands modified. It is admitted that the petitioner bears three criminal antecedent, as has been disclosed in the modification application and accordingly, the order stands modified.

5. Further four weeks' time is allowed to furnish the bail bond, subject to the payment of a cost of Rs. 5,000/- in Patna High Court Legal Services Committee, within two weeks. (Harish Kumar, J) shivank/- U T
