JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Ladaniya P.S. Case No. 135 of 2016 registered for the offences punishable under Sections 409,420 of the Indian Penal Code. Initially, the above stated Ladaniya P.S.Case No. 135 of 2016 was registered against the F.I.R named accused Sanjay Kumar with allegation that he defalcated huge amount of Panjab National Bank.
Subsequently, in course of investigation, it came to light that Rs. 30,000/- was transferred to the account of the petitioner and the aforesaid amount was withdrawn. The first information report itself reflects that the main accused, namely, Sanjay Kumar used several Bank accounts of the bone-fide
Patna High Court CR. MISC. No.74606 of 2019(4) dt.16-03-2020 2/2 consumers of the concerned Bank.
Moreover, having more or less, similar allegation some co-accused have already been admitted to anticipatory bail by different benches of this Court.
Accordingly, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Madhubani in Ladaniya P.S. Case No. 135 of 2016 subject to condition as laid down under Section 438(2) of the Cr.P.C.
