The petitioner seeks regular bail in connection with Gaya Railway P.S. Case No. 408 of 2018, registered for the offence punishable under Sections 420, 467, 468, 471, 379, 411/34 of the Indian Penal Code and Section 66(A) of the I.T. Act.

The allegation is regarding two persons having been arrested by the police and two ATM cards as also cash amounting to a sum of Rs. 40,000/- was recovered and upon interrogation, they are said to have disclosed the name of the petitioner and other accused persons.

The learned counsel for the petitioner has

No.75120 of 2019(2) dt.25-11-2019 2/2 submitted that the petitioner has been falsely implicated in the present case, no recovery has been made from the petitioner and the person, from whom recovery has been made, has already been granted bail by a coordinate Bench of this Court vide order dated 17.8.2019 passed in Criminal Miscellaneous No. 28906 of 2019. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 28.8.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Gaya in connection with Gaya Rail P.S. Case No. 408 of 2018.
