The petitioners apprehend their arrest in connection with Dalsingsarai P.S. Case No. 400 of 2017 for the offence registered under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that there is delay in lodging the first information report. However, the allegation is of attacking the deceased with hands and fists. It is further submitted that the entire prosecution case is suspicious and it has been drawn up by the Katib and not by the informant.

Considering the aforesaid facts and circumstances of the case and that the petitioners have not
