2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Kachhwan P.S. Case No. 178 of 2024 instituted for the offence under Sections 85/80(2) of B.N.S. and Section 3⁄4 of the Dowry Prohibition Act, 1961.

3. The case of the prosecution is that the marriage of the informant's daughter, namely, Shalu Kumari (deceased) was solemnized with this petitioner on 14.05.2021. After the marriage, the petitioner along with others persons started the deceased subjecting to cruelty on account of non-fulfillment of

It is further alleged that on 27.01.2024, the deceased has been assaulted due to which she has been admitted in Sadar Hospital, Aurangabad and also at B.H.U. Varanasi for better treatment but during the course of treatment, she died on 30.10.2024.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that though the petitioner is the husband of the deceased but from perusal of the Annexure-P/2, it will transpire that the deceased was undergoing treatment at B.H.U. and she has died on 30.10.2024. The provisional medical certificate of death-receipt of dead body goes to show that she was suffering from various disease. Learned counsel for the petitioner has submitted that the death is not otherwise rather the death was natural. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent.

5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner and submitted that the petitioner is the husband and the main thrust of allegation is against him.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Kachhwan P.S. Case No. 178 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Bikramganj, Rohtas subject to the conditions as laid down under section 482(2) of B.N.S.S.
