The petitioner seeks regular bail in connection with Mahua P.S.Case No.159 of 2016 registered for offences punishable under Sections 147, 148, 149, 504,506, 380, 427, 448 of the Indian Penal Code.

Prosecution case is that the petitioner and another accused person made indiscriminate firing on the deceased causing his death.

Submission of the learned counsel for the petitioner is that altogether three persons are named as the assailant but only one injury was found in the post mortem report. Petitioner is in custody since 22.8.2019.

Heard learned A.P.P. , who has opposed the prayer for

Patna High Court CR. MISC. No.72399 of 2019(4) dt.05-02-2020 2/2 bail.

Having heard both sides and in view of submissions as made above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Mahua P.S.Case No.159 of 2016.

With the above direction, this application is allowed.
