JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 Petitioner seeks regular bail in connection with Durgawati P. S. Case No. 227 of 2019 registered for the offences punishable under Sections 419, 420, 406, 467, 468, 471 and 120B of IPC.

As per F.I.R. it is alleged that petitioner and other accused persons are engaged in the fake appointment of the candidates and it is said that one Ramesh Kumar has taken Rs.1,50,000/- from the informant for providing the appointment, but he has not provided the appointment. On information, police went there and arrested the petitioner and other accused persons, on search, several articles were recovered from the possession of the petitioner and other accused persons.

Submission of the learned counsel for the petitioner is that even according to the F.I.R. the appointment was made to

Patna High Court CR. MISC. No.73423 of 2019(3) dt.10-01-2020 2/2 one Ramesh Kumar and petitioner has falsely been implicated in this case. He has no criminal antecedent. He is in custody since 13.08.2019.

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that petitioner is also the member, who are engaged for providing the job in the railway. Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Kaimur at Bhabua, in connection with Durgawati P. S. Case No. 227 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
