In view of the above, the application stands dismissed as withdrawn as against petitioner no. 2. Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in a case registered for the offence punishable under sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner

Patna High Court CR. MISC. No.78369 of 2019(2) dt.19-12-2019 2/2 submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the seized article. Petitioner has no criminal antecedent. Petitioner is in custody since 16.10.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner no.1, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II-cum-Special Judge, Excise, Gaya in connection with Giriak (Katrisarai) P.S. Case No. 109 of 2019.
