JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-12-2019 The petitioner seeks bail in connection with Araria(Bairgachhi) P.S. Case No. 891 of 2018 which has been instituted for the offences under Section 392 of the Indian Penal Code.

It appears that even though the petitioner has neither been named in the F.I.R nor there is any suspicion against him also but only because he has a tainted background, he has been remanded in the present fact. The aforesaid fact also gets reflected in a way in the impugned order.

The petitioner is on bail in all the cases which have been listed in paragraph 3 of the bail petition.

Regard being had to the fact that there is no material in the present case to sustain any further incarceration, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria (Bairgachhi) P.S. Case No. 891 of 2018.
