====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 28-01-2026 Heard learned counsel for the petitioner and learned APP for the State. Perused the case diary.

2. The petitioner seeks bail in connection with Laxmipur P.S. Case No. 290 of 2024, instituted for the offences under Sections 319(2), 318(4), 105, 352, 351(2) and 61 of the Bharatiya Nyaya Sanhita, 2023.

3. Prosecution case, in short, is that due to negligence of the petitioner, the daughter of the informant died during post operative period after bearing a child.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. He further submitted that petitioner is not the owner of Maa Durga Emergency Hospital, Kenuhat, rather, one Santosh Sah is the owner of the said hospital. The petitioner is neither Doctor nor

The daughter of informant died during course of delivery being helped by Asha worker, who subsequently advised to admit the deceased at Maa Durga Hospital. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.07.2025 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Laxmipur P.S. Case No. 290 of 2024.
