JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-04-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with G.R.No. 3602 of 2017 arising out of Danapur P.S. Case No. 745 of 2017 registered for the offences punishable under Sections 143, 149, 341, 323, 308 and 379 of the Indian Penal Code. There is specific allegation against these petitioners that they assaulted the informant's brother by means of pistol. As a result of which informant's brother sustained injuries. The injury report is not available on the record nor it has been mentioned in the impugned order.
However, taking note of the aforesaid allegation as well as submissions of the parties, this anticipatory bail petition
Patna High Court Cr.Misc. No.19600 of 2018 (2) dt.06-04-2018 2/2 stands disposed of directing the petitioners to surrender before the trial court within six weeks from today, and if they do so, and seek regular bail, the concerned court shall consider the regular bail of the petitioner on its own merit without being prejudiced by this order, particularly, keeping in mind the nature of injuries if any, sustained by the informant's brother.
