The petitioner seeks bail in connection with Mahua P.S. Case No. 344 of 2023 instituted for the offence under Sections 461, 379 of the Indian Penal Code (for brevity 'IPC') and subsequently, sections 411, 413, 414 of the IPC was also added.

The prosecution story, in brief, is that some miscreants are alleged to have committed robbery in the shop of of the informant, and while doing so, taken away mobile phones valuing 15-16 lakhs, laptops and other materials. 4.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30-06-2023. Petitioner

Patna High Court CR. MISC. No.81051 of 2023(2) dt.22-12-2023 2/2 bear one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner's name has been surfaced due to confessional state of co-accused, namely, Suraj Kumar Manjhi. Other coaccused have been allowed bail by Co-ordinate Bench of this Court passed in Cr. Misc. No. 58034 of 2023, Cr. Misc. No. 65247 of 2023 and Cr. Misc. No. 56877 of 2023. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Mahua P.S. Case No. 344 of 2023.
