The petitioners apprehend their arrest in connection with Madhepura Sadar P.S. Case No. 457 of 2014 registered under Sections 341, 342, 323, 308 and 504/34 of the Indian Penal Code. The informant alleged that on account of throwing water on road, some altercation took place between his mother, Bibha Devi and Sugiya Devi. Other family members of the petitioner came and assaulted his mother, sister and other family members.

Learned counsel for the petitioners submits that police after investigation has submitted charge-sheet against the

Patna High Court Cr.Misc. No.17946 of 2018 (2) dt.09-04-2018 2/2 accused persons. Accusations against all the four petitioners were found incorrect and accordingly final form, finding the case to be false, has been submitted but learned court below took cognizance in the order dated 15.06.2017. It appears that dispute between two female members of a family on account of throwing water and some assault took place.

Considering the facts that the police after investigation found the allegation false against the petitioners, let the petitioners, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each in connection with Madhepura Sadar P.S. Case No. 457 of 2014 to the satisfaction of the learned Chief Judicial Magistrate, Madhepura or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
