Heard learned counsel for the petitioners and learned A.P.P. for the State.

Learned counsel for the petitioners, after arguing vehemently for some time realising his difficulty, seeks permission to withdraw the anticipatory bail application with respect to petitioner no.1, Shailendra Yadav. 3.
Permission is accorded.

Accordingly, the anticipatory bail application is dismissed as withdrawn with respect to petitioner no.1, Shailendra Yadav.

The petitioners apprehend their arrest in a case
Patna High Court CR. MISC. No.78655 of 2025(2) dt.03-12-2025 2/3 registered for the offences punishable under Sections 191(2), 191(3), 126(2), 115(2), 109, 74, 303(2), 352, 351(2) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioners submits that petitioner no. 2 is a person with clean antecedent and petitioner no. 3 has antecedent of one case and the informant alleges that accused persons including the petitioners came on 25-2-2025 at 9 pm along with 4-5 unknown accused and Shailendra with Tengari and Neetu with Dabiya assaulted him causing injury on head, thereafter the accused person assaulted his father and mother and unveiled his mother, who became unconscious, while Dilip took Rs 1 lakh which was kept in the house and Sujit snatched his chain, further Prashant and Laxman assaulted by leg and fist.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that specific allegation of assaulting the informant by Tengari is against Shailendra and as far as these petitioners are concerned, they are alleged to have assaulted by leg and fist.

Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.78655 of 2025(2) dt.03-12-2025 3/3 anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioner nos.2 and 3 abovenamed, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Lalmaniya P.S. Case No. 16 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
