2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 149, 323, 324, 337, 379 and 307 of the Indian Penal Code.
3. Petitioner is alleged to have facilitated the alleged occurrence.
4. It is submitted that there is no specific allegation of assault against the petitioner. Specific allegation of stabbing is against co-accused Vikas Das and this petitioner is only alleged to have caught hold of the hand of the informant.
5. Learned counsel for the informant opposes the bail application and submits that this petitioner caught hold of the
Patna High Court CR. MISC. No.82751 of 2023(2) dt.18-01-2024 2/2 informant due to which he was stabbed.
6. Considering the nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai Benta O.P. P. S. Case No. 259 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
