The petitioner seeks bail in a case instituted for the offences under Sections 399, 402 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act and Section 37(C) of the Bihar Prohibition and Excise Act, 2016. Prosecution case, in short, is that the accused person alleged to have been arrested in drunken state. Allegation is also of recovery of one country made pistol and one live cartridge. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.1.2018. Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the

Patna High Court Cr.Misc. No.17806 of 2018(5) dt.15-05-2018 2/2 petitioner. It is alleged that one country made pistol and one live cartridge are recovered. The other accused persons are alleged to have been arrested in drunken state. Other co-accused has been granted bail vide order dated 19.03.2018 passed in Cr. Misc. No. 15512 of 2018.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Muzaffarpur P.S. Case No. 34 of 2018.
