JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Paliganj P.S. Case No. 177 of 2015 registered for the offence punishable under Section 392 of the Indian Penal Code.

As per FIR some miscreants snatched away motorcycle of the informant and petitioner is not named in the FIR and later on name of petitioner has come in the confessional statement of co-accused Inderjeet Kumar.

Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him and other co-accused persons have been granted bail by learned Sessions Judge.

Heard learned APP, who has opposed the prayer for anticipatory bail stating that in such cases custodial

Patna High Court CR. MISC. No.70004 of 2019(2) dt.15-11-2019 2/2 interrogation is required, as such petitioner does not deserve anticipatory bail.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender and pray for regular bail. This application is, accordingly, dismissed.
