2. The petitioner has prayed for bail in connection with Samastipur Town P.S. Case No.193 of 2024 registered for the offence punishable under Sections 3, 4, 5 and 7 of Immoral Traffic (Prevention) Act and Section 6 of the POCSO Act.
3. The case of the prosecution is that the petitioner is the manager of Amit Rest House in which it is alleged that flesh trade was going on. The police has examined the register of the hotel and on suspicion the manner in which the register was maintained, the hotel was raided and from that hotel, many persons were arrested in suspected condition.
4. Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.83452 of 2024(4) dt.05-03-2025 2/2 has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. During course of hearing learned counsel for petitioner has submitted that one of the victim has given her statement under Section 183 of the B.N.S.S. which is Annexed as Annexure-2 from perusal of which, it is clear that she has stated that on that day, there was birthday of one of the friend Anurag and that is why the hotel was booked. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. He is languishing in judicial custody since 12.09.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Court (POCSO), Samastipur in connection with Samastipur Town P.S.
