The petitioner apprehends his arrest in Raxaul P.S. Case No.123/2016 registered under Section 366A of the Indian Penal Code.

The mother of the informant alleged that the petitioner kidnapper her minor daughter from her house in the midst of night.

Learned counsel for the petitioner submits that the victim also made her statement under Section 164 of the Cr.P.C. but she did not alleged against the ill treatment at the hands of the petitioner but it appears from perusal of the statement of victim under Section 164 of the Cr.P.C. as well as F.I.R. that the victim

Patna High Court Cr.Misc. No.17747 of 2018 (2) dt.09-04-2018 2/2 also alleged that the petitioner kidnapped her and took her to Nepal.

Considering the aforesaid fact, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the anticipatory bail of the petitioner stands rejected in Raxaul P.S. Case No.123/2016 pending in the court of learned S.D.J.M., Raxaul at Motihari, East Champaran.
