JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-04-2018 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State. The petitioners seek anticipatory bail in connection with Nawada Nagar P.S.Case No. 64 of 2018, registered for offences punishable under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.

The allegation against the petitioners is that the informant got a sale deed in year 1982 with respect to 60 decimals of land from one Torni Devi and his son Bhola Sao and in the year, 2018 petitioners sold 14 decimals of land out of 60 decimals land of the informant to another person. Submission of the learned counsel for the petitioners

Patna High Court Cr.Misc. No.20217 of 2018(2) dt.12-04-2018 2/3 is that the petitioners have purchased the land to the son of the original landlord after verifying all the documents. It is also submitted that the petitioners have no criminal antecedents. Learned counsel for the informant and learned A.P.P. oppose the prayer of bail.

Having heard both sides and in view of the facts and circumstances as discussed above, let the petitioners, in the event of their arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs. 25,000/- ( Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Nagar P.S. Case No. 64 of 2018, subject to the condition that as laid down under Section 438 (2) of the Code of Criminal procedure.

With following conditions:- i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

ii) The petitioners will not induce any witness or tamper with the evidence.

iii)The petitioners shall co-operate in the investigation
