The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 327, 326 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is neither named in the FIR nor his name figured in the FIR even by way of suspicion. The petitioner has falsely been implicated in this case. On the basis of confessional statement, the petitioner has been made accused in this case. The petitioner was apprehended as non FIR accused by the police in connection with Barauni (ROP) Case No. 10/2019 on 04.05.2019 and whilst, he was in police custody. Learned counsel for the petitioner further submits that

Patna High Court CR. MISC. No.77824 of 2019(2) dt.29-11-2019 2/2 there is no T.I.P in this case. The petitioner is in custody since 26.05.2019.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Barauni (Refinery) P.S. Case No. 16 of 2019.
