JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Budha Colony P.S. Case No. 437 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 427, 504, 506 of the Indian Penal Code and Sections 3/4 of Damage of Public Property Act. As per FIR there is allegation against the petitioners, who are said to be trainee Constables, that they along with others were engaged in assaulting the informant, damaging the vehicles and also disturbing the official work of police officials.

Patna High Court CR. MISC. No.73734 of 2019(2) dt.25-11-2019 2/2 Submission of learned counsel for the petitioners is that there is no specific allegation against the petitioners and moreover they have now been removed from the service, as such they have already been punished.

In view of above facts and circumstances, let petitioners, in the event of surrender within a period of three weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-cumSub-Judge-XVI, Patna, in connection with Budha Colony P.S. Case No. 437 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
