Petitioner, already in custody, seeks bail in connection with Bhawani Pur (Baliya O.P.) PS Case No.165 of 2017 registered under Sections 365, 370 and 372/34 of the Indian Penal Code as well as under Section 5 of the Immoral Traffic Act.

Allegation in brief is that the daughter of the informant was kidnapped by the petitioner and other associate and it is alleged that they were trying to sell the girl to some person.

Learned counsel for the petitioner submits that the girl had in her statement recorded under Section 164 Cr.P.C. said that she was returning back from her maternal grandfather's

No.18587 of 2018(4) dt.22-06-2018 2/2 house then on the way this petitioner and one another enticed her and brought to her house and kept for two days and they wanted to get her married with a boy but there is no allegation of any sexual exploitation of the girl and the girl is major 18 years of age and the petitioner is in custody for last one year. It is also submitted that the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Suman Devi @ Soman Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Purnea in connection with Bhawani Pur (Baliya O.P.) PS Case No.165 of 2017, giving rise to Sessions Trial No.329 of 2017 with condition that the petitioner shall remain physically present on each and every date before the trial court and if she absents herself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled.
