JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Excise Case No. 617/2019 arising out of Kaler P.S. Case No. 41/19, registered for offences punishable under Sections 420, 467, 468 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act 2016.
Allegation is of recovery of 1944 litres of liquor from the truck and petitioner is said to be the driver of the truck. It has been submitted on behalf of the petitioner that he has no criminal antecedent and has falsely been made accused in this case and he has nothing to do with the seized liquor and he has been in judicial custody since 07.06.2019. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on
Patna High Court CR. MISC. No.71081 of 2019(2) dt.13-01-2020 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II, Jehanabad, in connection with Excise Case No. 617/2019 arising out of Kaler P.S. Case No. 41/19, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds with further subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned court below.
The court below is also directed to verify the address of the petitioner as well as the address of the bailor before releasing the petitioner on bail.
