JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Nawada Muffasil P.S. Case No. 179 of 2016 registered for the offences punishable under Sections 406, 420/34 of the Indian Penal Code.
It is alleged that informant gave rupees nine lacs to petitioners for running a brick kiln on the assurance of getting partnership but subsequently, neither he was made partner of the aforesaid brick kiln nor the above stated money was returned. Learned counsel for the petitioners submits that parties have already compromised the case outside the court which
Patna High Court Cr.Misc. No.19189 of 2018 (2) dt.05-04-2018 2/2 is evident from perusal of Annexure-2 to this petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in Nawada Muffasil P.S. Case No. 179 of 2016 subject to condition as laid down under Section 438(2) of the Cr.P.C.
