====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has prayed for bail in connection with Amarpur P.S. Case No. 410 of 2019 registered for the offences under Sections 341, 323, 385, 387 and 34 of the Indian Penal Code and 37(C) of Bihar Prohibition & Excise Act, 2016. As per allegation in the FIR, while the informant was returning on his motorcycle, two persons stopped him and assaulted with their hands and demanded Rs. 50,000/-. It further transpires in the FIR that two persons including this petitioner was caught and taken into custody.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the instant case. No incriminating article was recovered from his possession. It is

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II, Banka, in connection with Amarpur P.S. Case No. 410 of 2019.
