Petitioner is an accused in a case registered for offence under Sections 363, 366(A), 34 of the Indian penal Code. It is submitted by learned counsel for the petitioner that from perusal of the statement given by the victim girl under Section 164 Cr.P.C. who claims to be 14 years old, it appears that she was tormented by her father and has found solace with the petitioner. She has specifically denied the allegation of being kidnapped in her statement given under Section 164 Cr.P.C. The petitioner is in custody since 13.12.2017.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned

Patna High Court Cr.Misc. No.18669 of 2018 (3) dt.21-05-2018 2/2 above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sub-Judge-3rd-A.C.J.M., West Muzaffarpur in Paroo P.S. Case No.261 of 2017 on the following conditions : - One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
