JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioner seeks regular bail in connection with Bhargama P. S. Case No. 211 of 2019 registered for the offences punishable under Sections 272, 273, 34 of the IPC and Section 30(a) of the Bihar Prohibition & Excise Act, 2018. Recovery of 343 liters of liquor from the Orchard of the co-accused and the F.I.R. disclosed that petitioner and other accused are also engaged in the same.

Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against him. He is not the accused of similar type of case. The other accused persons having similar type of allegation, have been granted bail by Co-ordinate Benches of this Court, vide order dated 10.12.2019 passed in Criminal Misc. No. 80856 of 2019 and order dated 20.12.2019 passed in

Patna High Court CR. MISC. No.72638 of 2019(2) dt.13-01-2020 2/2 Criminal Misc. No. 84738 of 2019. Further submission is that he is in custody for four months. Charge sheet has already been submitted, as such, there is no chance of tampering with the evidence.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Araria, in connection with Bhargama P. S. Case No. 211 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
