The petitioner apprehends his arrest in connection with Balrampur P.S. Case No. 48 of 2019 registered under Section 30(a) of the Excise Act pending in the Court of A.D.J.- II-cum-Special Judge, Katihar.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to local politics and ulterior motive. Petitioner has no criminal antecedent.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is owner of the alleged vehicle, in which illegal wine was recovered. Hence, the petitioner does not deserve

Patna High Court CR. MISC. No.74991 of 2019(2) dt.05-02-2020 2/2 anticipatory bail.

Having considered the above facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner for bail is rejected.
