2. The petitioner is in custody in connection with Baijnathpur P.S Case No. 74 of 2024 registered for the offences punishable under Sections 338, 336(3), 318(4) of B.N.S, 2023 and Section 10 of Bihar Examination Act.

3. As per prosecution case, other person is appearing in the examination in place of petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that one of the co-accused who is appearing in examination in place of petitioner is granted bail by the trial Court. It is also submitted that petitioner is in judicial custody

Patna High Court CR. MISC. No.78301 of 2025(2) dt.03-12-2025 2/2 since 21.08.2025 and he has got no criminal antecedent as stated in paragraph no. 3 of the bail petition.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that co-accused who has appeared in examination in place of petitioner is already granted bail by the trial Court. Petitioner has got no criminal antecedent as stated in paragraph no. 3 of the bail petitioner. Petitioner is custody since 21.08.2025.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Saharsa in connection with Baijnathpur P.S Case No. 74 of 2024.
