The petitioner seeks regular bail in connection with Amdabad P.S. Case No. 156 of 2019 registered for the offence punishable under Sections 379, 411 of the Indian Penal Code. The prosecution story as per the First Information Report is that the bicycle of the informant was stolen from outside of his house by some unknown persons. It has further been alleged that the same was recovered from the possession of one Basant Kumar Das, who disclosed that the said bicycle was purchased by him from one Ranjit Kumar Das i.e. the petitioner. Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and has falsely been implicated in this case merely on the statement made by the
Patna High Court CR. MISC. No.72520 of 2019(2) dt.04-12-2019 2/2 arrested co-accused. Learned counsel further submits that petitioner is in custody since 13/09/2019.
Having heard learned counsel for the parties and taking into consideration the fact that petitioner has got no criminal antecedent and he is in custody since 13/09/2019, I am inclined to enlarge the petitioner on regular bail. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Amdabad P.S.
