JUSTICE RAJESH KUMAR VERMA ORAL ORDER 25-04-2025 Heard Mr.Ravi Nandan, learned counsel for the petitioner, learned counsel for the informant and Mr.Anil Kumar, learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in connection with Ara Nawada P.S. Case No.215 of 2024, dated 26.03.2024 registered for the offences punishable under Sections 341,323,307,504,506,34 of IPC and Section 27 of Arms Act.

3. According to prosecution case, all the accused persons including the petitioner have assaulted the informant and his family members by means of deadly weapon. It is further alleged that the petitioner shot fire upon the nephew of the informant with an intention to kill him.

4. Learned counsel appearing for the petitioner

Patna High Court CR. MISC. No.2974 of 2025(3) dt.25-04-2025 2/2 submits that the petitioner has clean antecedent and he has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.

Learned counsel for the informant and learned A.P.P. for the State have vehemently opposed the prayer for anticipatory bail of the petitioner and submits that from a bare perusal of the FIR it appears that there is direct and specific allegation of firing attributed against the petitioner that he has fired upon the nephew of the informant with an intention to kill him and he has received the injury.

Considering the aforesaid facts, there is direct and specific allegation against the petitioner that he has fired upon the nephew of the informant with an intention to kill him and he has received the injury, I am not inclined to grant privilege of anticipatory bail to the petitioner in connection with Ara Nawada P.S. Case No.215 of 2024 pending in the court of learned Chief Judicial Magistrate, Bhojpur, Ara.

7. Prayer is refused.
