The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25(1-b)a, 26, 35 of the Arms Act and Sections 8/20(b) (ii) (c) of the N.D.P.S. Act.

As per FIR, co-accused persons were apprehended on the spot and from their possession 1527 grams ganja one country made loaded katta, one live cartridge and one TVS motorcycle were recovered and they confessed that the petitioner was also their associate.

Learned counsel for the petitioner submits that the

He has falsely been implicated in the present case merely on the basis of confessional statement of co-accused. Neither the petitioner was apprehended on the spot nor any incriminating article has been recovered from his conscious possession. It is further submitted that the petitioner is languishing in judicial custody since 11.10.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ghorasahan P.S. Case No. 501 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge-cum Special Judge, East Champaran, Motihari.
