The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Laxmipur P.S. Case No. 69 of 2019, registered for the offence punishable under Sections 420, 467, 468, 471 and 120 (B) of the Indian Penal Code.

As per allegation made in the F.I.R., petitioner was Panchyat Sevak of Gram Panchyat Raj Nazari under police station Laxmipur in the district of Jamui. In course of investigation it transpired that the experience certificate of one person was found illegal while with respect to other persons no record was available in the office.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.76220 of 2019(2) dt.25-11-2019 2/3 that the petitioner had no role in issuance of the experience certificate. It is further submitted that case of the petitioner stands on similar footing to that of co-accused who has been enlarged on anticipatory bail vide order dated 20.08.2019 passed in Criminal Misc. No. 51853 of 2019.

It is submitted by the learned counsel for the State that the petitioner did have a role to play in the matter as he was one of the members of the selection committee who were required to see that the experience certificate was proper or not or whether it contained all the required signatures/stamps etc. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, specially the fact that a similarly situated co-accused has been enlarged on anticipatory bail and the petitioner has no criminal antecedent, this Court is inclined to grant anticipatory bail to the petitioner and he is directed to surrender in the court below within a period of six weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Jamui, in connection with Laxmipur P.S. Case No. 69 of 2019, subject to the condition laid down under
