ANJANA MISHRA ORAL ORDER 14-02-2020 The present writ application has been filed for seeking a direction to the authorities, namely, Respondent Nos.5, 6 and 7, to take appropriate steps to arrest the private Respondent Nos.8 to 12 in connection with Saksohra P.S. Case

Patna High Court CR. WJC No.1896 of 2019(4) dt.14-02-2020 2/2 No.16 of 2019 registered under Sections 147, 148, 149, 323, 341, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act lodged by the petitioner for committing the murder of his son-in-law in broad daylight.

Learned counsel for the State submits that a counter affidavit has already been filed in this case where it has been found after investigation that the case was one of accidental death and, therefore, the entire allegations appear to be palpably false.

Learned counsel for the petitioner, however, submits that in response to the said report, the petitioner has already filed a protest petition before the court below and therefore, he seeks permission to withdraw the case with liberty to pursue the protest petition before the court below.

The permission so sought is granted.
