2. The petitioners seek regular bail in connection with Pawana P.S. Case No. 68 of 2023 registered for the offence under Sections 304B, 201, 120B of the IPC and 3 / 4 of the Dowry Prohibition Act.

3. It is a case of dowry death of the deceased for nonfulfillment of demand of dowry.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. They are in judicial custody since 16.08.2023.

5. However, learned APP for the State vehemently

Patna High Court CR. MISC. No.80877 of 2023(4) dt.18-03-2024 2/2 opposed the prayer for regular bail.

6. On perusal of the FIR and case diary, it appears that on the basis of written report of the informant Durgavati Devi, mother of the deceased, First Information Report was lodged against petitioners and seven co-accused persons. Petitioner No. 1 is near brother of the husband of the deceased and petitioner No. 2 is father-in-law of the deceased and there is no specific allegation against the petitioners.

7. Considering the aforesaid facts and circumstances of the case and also taking into account the period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Smita Kumari, J.M. 1st Class, Bhojpur at Ara in connection with Pawana P.S. Case No. 68 of 2023.
