2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 7 of the Essential Commodities Act.

As per the prosecution case, the informant alleged that upon inspection, substantial irregularities were found between the stock recorded in the POS machine and the actual physical inventory by the District Agriculture Officer and the Assistant Agriculture Officer (Chemicals), Sitamarhi. A deficit of 843 bags of Urea, 6 bags of DAP, 8 bags of NPK, and 17 bags of Ammonium Sulphate was discovered. The physical

4. Learned counsel for the petitioner submits that petitioner is owner of licensed firm dealing in fertilizer since 2008 bearing license No. D-SL 20610052592589. As a matter of fact, E-POS machine work on internet/wifi and due to techinical glitch in the e-POS machine , there was discrepancy in the same and only on suspicion , concerned authorities lodged this case against petitioner. It is further submitted that license of the PDS shop of the petitioner has already been cancelled vide order dated 30.08.2025 , Letter No. 505 issued by District Agriculture Officer, Sitamarhi i. e ,. Annexure - 3 bail petition . Petitioner claims clean antecedent.

5 . Learned counsel for the State opposes the bail petition of the petitioner.

Considering the fact that license of the petitioner has already been cancelled and he claims clean antecedent, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of the Judicial Magistrate 1st Class Sitamarhi in
