ANJANA MISHRA ORAL ORDER 27-04-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 18.12.2017 in connection with University P.S. Case No.32 of 2017 registered for the offence under Sections 25(1-B)A/26/35 of the Arms Act, Section 3/5 of the Explosive Substances Act and Sections 452, 386, 387, 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the alleged recovery of firearm is not from the conscious possession of the petitioner. It is further submitted that the allegation of recovery of explosive substance was also from co-accused and not from this petitioner.

Considering the aforementioned facts and

No.19002 of 2018 (3) dt.27-04-2018 2/2 circumstances and that the petitioner is not having any criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge VIII-cum-Additional Chief Judicial Magistrate VIII, Muzaffarpur, in connection with University P.S. Case No.32 of 2017.
