The petitioner is apprehending his arrest in connection with Tajpur (Halai OP) P.S.Case no.202 of 2017 dated 9.7.2017 , G.R.No.1897 of 2017 registered for offences punishable under Section 394 of the Indian Penal Code.

Petitioner is not named in the FIR and later on his name transpired during the course of investigation of the case. Submission of the learned counsel for the petitioner is that his name transpired on the basis of statement of one spy on the basis of statement of the co-accused, from whose house mobile was recovered and except that there is no other allegation against the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.

No.18947 of 2018 (3) dt.08-05-2018 2/2 Having heard both sides and in view of nature of the case as well as allegation, this is not a case for grant of privilege of the anticipatory bail rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order an make prayer for regular bail which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court, if possible on the same day.
