ANJANA MISHRA ORAL ORDER 03-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 02.09.2019, in connection with Complaint Case No. 1668 of 2017 for the offences under Sections 354(B) and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation against the present petitioner is false and mischievous and only because the petitioner has had participated in the negotiations of the marriage between the complainant and her husband with whom he is having matrimonial dispute. The present case has been lodged against

Learned counsel for the petitioner further submits that on account of such malicious prosecution, the petitioner has been languishing in jail. It is further submitted that the petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Banka in connection with Complaint Case No. 1668 of 2017.
