JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-05-2018 The juvenile/petitioner seeks his release from the observation home where he has been lodged since 05.12.2017 in connection with Sakri P.S. Case No. 48 of 2017 instituted for the offence under Section 394 of the Indian Penal Code.

The petitioner was declared a juvenile by the Juvenile Justice Board with reference to the date of occurrence. The learned counsel for the juvenile/petitioner has submitted that he has not been named in the F.I.R and his implication in the present case is only on the basis of confession of a co-accused. Earlier, the juvenile/petitioner

Patna High Court CR. REV. No.331 of 2018 (3) dt.08-05-2018 2/3 was also made an accused in a case of similar nature but in the aforesaid case, he has been released from the remand home by the Juvenile Court. There is nothing on record, it has been argued, to suggest that the release of the juvenile/petitioner from the observation home would lead to his moral and physical degradation or that there would be a strong possibility of his falling in bad company. The juvenile/petitioner has approached this Court through his mother, who is ready to undertake that she shall take good care of her son.

Considering the nature of accusation against the juvenile/petitioner and the period for which he has remained in the remand home, this Court is inclined to release him from the observation home.

The petitioner/juvenile, above named, is directed to be released on his furnishing bond in the sum of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Principal Magistrate, Juvenile Justice Board, Madhubani in connection with Sakri P.S. Case No. 48 of 2017.

One of the bailors shall be the mother of the petitioner, who at the time of filing of her bonds shall furnish an undertaking that she shall take good care of her son and shall report about any disobedience of her son to the Officer-
