2. The petitioner seeks bail in a case registered for the offence punishable under Sections 80 and 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner along with other co-accused persons is said to have killed the daughter of the informant due to non-fulfillment of demand of dowry.

4. Learned counsel for the petitioner submits that the petitioner happens to be the father-in-law of the deceased and he was not present at the place of occurrence rather he was working at Kolkata being a cobbler by profession. It is further submitted that the death of the deceased had taken place on account of asphyxia caused by hanging as she had committed suicide. Further, the husband of the deceased is languishing in custody since 18.07.2025, which has been specifically mentioned in paragraph-10 of the bail petition. The petitioner is in custody

5. Learned APP for the State opposed the grant of bail on the basis of allegation made in the First Information Report.

6. Taking into consideration the facts and circumstances and considering that the petitioner is an old fatherin-law while the husband of the deceased, who is primarily responsible for the welfare of his wife, is already in custody, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions Judge-III, Khagaria/concerned Court below in connection with Khagaria (Gangour) P.S. Case No.06 of 2025 subject to condition that:- (i) The petitioner shall cooperate in the trial and in case of his non-cooperation, his bail bonds shall be liable to be cancelled by the learned court concerned.
