The petitioner is languishing in custody for the offences punishable under Sections 399/402 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act. The petitioner and others were apprehended on suspicion that they were planning to commit dacoity. From the possession of the petitioner chili powder was recovered. Fire-arm was recovered from the possession of co-accused Pintu Singh. Co-accused Gorakh Mahto has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.43032 of 2017. Petitioner is in custody since 12.07.2017.
Considering the period already undergone by the
Patna High Court Cr.Misc. No.19569 of 2018 (2) dt.11-04-2018 2/2 petitioner, let the petitioner, above named, be released on bail after framing of the charge on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Barhara (Krishnagarh) P.S. Case No.199 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
