This application for regular bail arises out of Excise Case No. 421 of 2019, Computer Registration No. 471/2019, disclosing the offence under Section 30(a) of the Bihar Excise and Prohibition Act, 2016.

From the court-yard of the petitioner's house, the excise officials are said to have recovered 89.60 litres of illicit foreign liquor.

Learned counsel for the petitioner has submitted that the place from where the recovery has been made, is a joint family property. The petitioner is in custody since 21.09.2019. Considering the facts and circumstances and the period for which the petitioner has remained in custody, this

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise Act, Samastipur in Excise Case No. 421 of 2019.

This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
