2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code in connection with Dulhin Bazar P.S. Case No. 168 of 2023.

3. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Petitioner has got one criminal antecedent of similar nature mentioned in Para 3 of the bail application in which he is on bail. He further submits that petitioner is not named in the F.I.R. but during the investigation one co-accused person was apprehended by the Police and before the Police he disclosed the name of the petitioner and on that basis he has made accused

Patna High Court CR. MISC. No.80644 of 2023(2) dt.18-12-2023 2/2 in the present case. He further submits that there is dispute between the father of the accused and therefore he put the name of the petitioner.

4. Learned APP for the State has opposes the prayer for bail.

5. Considering the facts and circumstances of the case of similar nature, I am not inclined to grant anticipatory bail to the petitioner.

6. Hence, the prayer for bail of petitioner stands dismissed.

7. However, if the petitioner surrender before the learned Court below within six weeks from today and seek regular bail, the learned Court below would pass order on the same day in accordance with law without being prejudiced by this order.
