2. The present writ petition is filed for the following relief(s):- " To direct the respondent authority to make payment of the work/tender with respect to Agreement no.-14 MMGSY(Gen)/SBD/2021-22 by which petitioner has to execute - Construction &

Patna High Court CWJC No.18266 of 2024(4) dt.06-08-2025 2/3 Five Year Maintenance of road from MMGSY ROAD TO NARAUNI TOLA TAK PATH UNDER MMGSY (Gen.) Length--0.525 Km. (Tender ID-100355).

ii. To direct the respondent authority to extend /pay the maintenance cost of the road in the question for the year 2023-24, as per the terms of agreement so stipulated.

iii. To direct/penalize the respondent authority for delaying the payment as well as litigation cost for the present petition.

iv. To any other order/orders for which petitioner is entitled for in the facts and circumstances of the case."

In the counter affidavit filed by the respondents, they have annexed the Allotment Requisition Format, Rural Works Department MMGSY (Gen.), wherein the total value of the works done by the petitioner has been mentioned and also the amounts which was already paid to the petitioner. Further the balance amount which is payable to the petitioner is also mentioned as 21,81,041/-.

Having regard to the fact that the work has already been completed by the petitioner and the authorities are not denying the same, the respondents authorities are directed to make the balance payment of the admitted dues to the petitioner as expeditiously as possible preferably within a period of 12 weeks from the date of receipt of a copy of this order.

5. With the above direction, the present writ petition stands disposed of.
