Petitioner is in custody in Town PS Case No. 275 of 2016, Sessions Trial No. 738 of 2018 (CIS No. 732 of 2018) registered under Sections 302, 120B, 34 of the IPC and Section 27 of the Arms Act.

It is submitted by petitioner's Counsel that statement of the informant as well as PW 1 which have been recorded does not support the allegations made in the FIR. Petitioner is in custody since 18.9.2018, even though statement of the informant was recorded on 8.3.2019 and that of PW 1 on 1.3.2019. Petitioner is already on bail in other cases details of which have been disclosed in para 3.

Considering the aforesaid submissions prayer for bail of the petitioner is allowed.

Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two

No.76166 of 2019(3) dt.09-12-2019 2/2 sureties of the like amount each to the satisfaction of Additional Sessions Judge VI, Begusarai in Town PS Case No. 275 of 2016, Sessions Trial No. 738 of 2018 (CIS No. 732 of 2018) subject to the following conditions:- (I) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
