Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. The FIR of the occurrence of theft is against unknown. The petitioner is in custody since 21.11.2017. Investigation of the case is complete. Nothing has been recovered from possession of the petitioner nor the petitioner was ever put on TI Parade. Only material is confessional statement of the petitioner while in police custody which is no evidence in the eye of law.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.19871 of 2018 (2) dt.12-04-2018 2/2 satisfaction of learned Court below where the case is pending in connection with Turkauliya (Banjariya) Police Station Case No. 430 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
