2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 326, 307, 427/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution is that while the informant along with driver Santosh Singh, gunman Anil Kumar Yadav and Pratosh Kumar was on route with Rupees One crore cash on the cash van for loading in the ATMs and in the meantime, the miscreants, riding on two bikes, chased the said van and shot fire, causing bullet injury to the driver of the van.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that initially the case was lodged against unknown miscreants.

There is nothing except the statement of the co-accused. Similarly situated other co-accused namely, Rituraj whose name has surfaced in the statement of Anand Kumar has been granted bail in Cr. Misc. No. 22987 of 2022. The case of this petitioner stands on similar footing. It is further submitted that the petitioner is languishing in judicial custody since 06.06.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner is having criminal antecedents of six cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Runnisaidpur P.S. Case No. 363 of 2019 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi.
